CBP Notice of Proposed Rulemaking (NPRM) CTPAT Program: Brokers Get a Seat at the CTPAT Table
 
                U.S. Customs and Border Protection (CBP) has issued a Federal Register notice launching a five-year pilot program that, for the first time, allows freight brokers and warehouse-based third-party logistics providers (3PLs) to participate in the Customs-Trade Partnership Against Terrorism (CTPAT) program.
Established in 2001 to strengthen supply-chain security and deter terrorism and smuggling, CTPAT provides certified participants with benefits such as reduced inspections and expedited processing for those meeting CBP’s minimum security standards. Historically, non-asset-based brokers were excluded, until Congress enacted the CTPAT Pilot Program Act of 2023 (Public Law 118-98) in fall 2024, a hard-fought victory for TIA.
As part of the pilot program, CBP will select 10 freight brokers and 10 warehouse facilities on a first-come, first-served basis. Participants can express their intent to join by emailing CBP. After receiving expressions of intent. If chosen, each participant will be assigned a Supply Chain Security Specialist to verify eligibility for asset-based or non-asset-based 3PL participation. The full application process will require selected 3PLs to complete a company and security profile before being approved for participation in the pilot program
